These Terms of Service ("Terms") govern your use of No Sweat Leads (the "Service"), operated by Franklin Thomas Izzo ("we," "us"). By creating an account or using the Service, you agree to these Terms.
You must be at least 18 years old and able to enter a binding contract. If you use the Service for a business, you represent that you are authorized to act on its behalf.
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.
No Sweat Leads lets you contact leads by text and email. You are solely responsible for ensuring you have a lawful basis and any required consent to contact the people you import and message. Specifically, you agree that:
The Service uses AI to suggest price quotes and message drafts. These are estimates and suggestions only. You are responsible for reviewing them before sending or relying on them. We do not guarantee that any AI-generated quote or message is accurate, complete, or appropriate for a given situation.
The Service relies on third parties including Supabase, Anthropic, Twilio, Stripe, and our email and hosting providers. Your use of the Service is also subject to their terms where applicable, and we are not responsible for their acts or outages.
We own the Service and its software. You retain ownership of your own data (your account information, leads, and message content). You grant us a limited license to process that data solely to provide the Service to you.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that messages will always be delivered.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of your use of the Service, your content, or your violation of these Terms or of any law — including claims arising from messages you send.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends; provisions that by their nature should survive (such as disclaimers and limitations of liability) will survive.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, communicated to you. Continued use after changes take effect means you accept them.
These Terms are governed by the laws of Michigan, United States, without regard to conflict-of-law rules. Disputes will be resolved in the courts located there, unless applicable law provides otherwise.
